PRIVACY POLICY
Healing Daruma understands how important your privacy is. The following describes how Healing Daruma LLC (“Healing Daruma,” “I,” “me” or “my”) uses and disseminates information you provide through https://www.healingdaruma.com and its sub-domains and affiliated sites, as well as Healing Daruma LLC’s (“Healing Daruma” “my”, “me” or “I”) pages and accounts on Facebook®, Instagram® and YouTube® (the “Sites”). This privacy policy (the “Privacy Policy”) sets out the privacy policies and practices for Healing Daruma LLC and its subsidiaries and affiliates (collectively, “Healing Daruma”) with respect to how Healing Daruma collects your personal information. It also describes how Healing Daruma maintains, uses, and discloses personal information. This Privacy Policy applies to information collected from you by Healing Daruma via the Site. This Privacy Policy also sets out how you can access certain information that Healing Daruma may collect about you.

In this Privacy Policy, personal information means information about an individual whose identity is apparent or can be reasonably ascertained from the information as further defined under applicable privacy laws (“Personal Information”).
Please note that the Site may contain links to other third-party websites that are not controlled or operated by Healing Daruma. All of these third parties are listed in section 5.4 of this Agreement. This Privacy Policy does not apply to such third-party websites, and Healing Daruma is not responsible for the content of such third-party websites or the privacy practices of such third parties. Healing Daruma encourages you to request and review the privacy policies of any third parties upon disclosing your Personal Information to such parties or when visiting such third-party websites.
1. Consent of Collection of Your Personal Information. Unless I expressly note otherwise, I do not collect personally identifiable information from users of my Sites. When you visit my Sites, some information about your computer hardware and software is inherently automatically collected, such as your IP address, domain name, browser type, access time and referring website addresses. I typically do not use this information for any purpose, but an example of when I may use this information is in implementing improvements and analyzing the Sites and for troubleshooting purposes. I also utilize this information to monitor and improve services and to ensure that your use of the Sites is in compliance with my Terms of Use. Most of our services do not require any form of registration, allowing you to visit the Sites without telling us who you are. However, some services, such as email opt-ins may require you to provide us with Personal Data. In such a case, you may choose to withhold any Personal Data requested by us, but it may not be possible for you to gain access to certain parts of the site or content. We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us. By submitting Personal Information to Healing Daruma and its Site or any of its service providers, you agree and consent to the collection of your Personal Information and consent to the use, disclosure and transfer of your Personal Information in accordance with the provisions of this Privacy Policy. You may always refuse or withdraw your consent by contacting Healing Daruma at legal@healingdaruma.com. You understand that if you withdraw your consent, Healing Daruma may not be able to continue to offer its services and provide its information to you.
2. International Privacy Laws and Your Rights Under the GDPR. If you are visiting the Site from outside the United States, please be aware that you are sending information to the United States where my servers are located. Information you submit may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by me. These countries (including the United States) may not necessarily have data protection laws as comprehensively protective as your country of residence; however, my collection, storage, and use of your data will at all times continue to be governed by this Privacy Policy. If you are a member of the European Union (EU), you have special rights under the GDPR. Those include: You have the right to object to the processing of your data and the right to portability of your data. All complaints must be sent to legal@healingdaruma.com. You also have the right to erasure, rectification, access, or to seek restrictions to the processing of your personal data in our system. To the extent you provide consent to our processing of your personal data, you have the right to withdraw that consent at any time. Any withdrawal of consent does not apply to data collected lawfully prior to such consent. You have the right to lodge a complaint with a supervisory authority containing jurisdiction over GDPR related issues.
3. Children Under 18. The Site is not intended for children under 18 years of age. No one under the age 18 may provide any Personal Information to or on the Site. Healing Daruma does not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on the Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If Healing Daruma learns we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. If you believe Healing Daruma might have any information from or about a child under 18, please contact us at legal@healingdaruma.com.
4. Revisions to this Privacy Policy. Healing Daruma reserves the right, in Healing Daruma’s sole discretion, to change, modify, add or remove portions of this Privacy Policy at any time and from time to time without prior notice to you. Healing Daruma will treat your continued use of the Site following such revision as your acceptance of the revised terms. All revisions will be posted to the Site and will apply to any Personal Information collected on or after the date posted. Healing Daruma will obtain the necessary consents required under applicable privacy laws if it seeks to collect, use or disclose your Personal Information for purposes other than those to which consent has been obtained, unless otherwise required or permitted by law.
5. What Personal Information does Healing Daruma collect, and how is it processed?
5.1. What do we collect? Healing Daruma may directly collect your name, address, phone number, birthday, billing address and email address. There may be other information you provide, but that will not be collected by Healing Daruma and instead will be collected by the third parties Healing Daruma works with as outlined in 5.4.
5.2. Email. We may send you a newsletter or other promotional materials through email. We will only contact you through our newsletter for promotional or informational purposes. Subscribing to our newsletters is optional, and you will always be able to unsubscribe. This applies to any information you submit through our website or that you provide to us in any other manner.
5.3. Phone Number. We may collect your phone number, and we may contact you via phone if we feel there is information that would be beneficial to share with you. In accordance with everything outlined in this Privacy Policy, if you do not want to be reached by phone, you can ask us not to contact you via phone, or you can choose not to share your phone number.
5.4. Third Parties. Healing Daruma may work with third-party applications in order to provide you with the best services on the Site. These organizations may collect Personal Information from you in order to provide you with the services, including your name and contact information. Specifically, the third parties Healing Daruma may work with on the Site are listed below. We’ve included links to their privacy policies to ensure you are comfortable using them.

6. How will Healing Daruma use your Personal Information? Your Personal Information will be used to provide you with promotional and informative materials and offers and deliver the products and services you can purchase or subscribe to from the Site. Specifically:
6.1. Your credit card information will not be kept by Healing Daruma but instead by one of the third parties listed in section 5.4 above;
6.2. Your name and e-mail address are collected but will not actually be stored on the Site. Any information captured will be processed through third-party websites in section 5.4 above;
6.3. Your phone number may be used to contact you via phone if there is information we would like to share that we feel would benefit you;
6.4. If you subscribe to our newsletter, your Personal Information will be used to send the newsletter to you;
6.5. If we send you the Newsletter for marketing purposes, we will send you emails about promotions, special events and other information. You can opt not to receive these emails from us by either clicking “unsubscribe” at the bottom of the email when you receive it or by sending an email that includes your email address and a request that you not receive our promotional emails;
6.6. We may use your Personal Information to respond when you submit a question or suggestion to us or when you request assistance regarding a service or product you purchased.
6.7. We may share your information if we believe in good faith that disclosure of your information is required to protect your safety or the safety of others, to investigate a fraud, or to respond to a government, judicial or other legal request or to comply with the law;
6.8. We may also share certain aggregated, anonymized information with a third-party provider in order to assist us in improving the Site.
7. Storing Your Personal Information. Healing Daruma’s web service may store your Personal Information when you interact with the Site. Healing Daruma will be happy to delete any of your Personal Information that it holds upon a written request made by you. Your Personal Information will be safely disposed of by Healing Daruma.
8. Storing Your Phone Number. Your phone number will be kept in the phone or contacts database of Healing Daruma and associates. Wherever it is stored, it will always be protected with a password and will never be shared with third parties without your permission.
9. We Play by The Rules. The Site and Healing Daruma abide by all relevant United States federal and State privacy laws in all aspects of our operations. 10. Affiliate Relationships. Please assume that, for every recommendation or link we provide, the following holds true: we have become aware of a product or service that we think may be of interest to people who visit our website. After we do our own research and decide this item is of value to ourselves, our community, or our clients, we choose to promote that item and are compensated when our readers click on the link or purchase the product or service. (That compensation comes from our affiliate, not you). Regardless of compensation, we only mention products and services that we believe in and feel would be a benefit to you.
11. Do Not Track Signals. Healing Daruma currently does not recognize or respond to browser-initiated Do Not Track (DNT) signals, as the Internet industry is currently still working on Do Not Track standards and there is no accepted standard on how to respond to such signals.
12. Analytics. The Site keeps the following information from your visits to our webpage:
12.1. Visitor information to improve our customer engagement which tells us where and when people visit the Site, how long they stay there; and
12.2. IP information for website and server security.
13. Cookies. The Site uses ‘cookies’ to keep a record of the number of times you’ve visited the Site and how you interacted with the Site during each visit. In addition to this, the Site also uses cookies which are not absolutely essential for your use of the Site. Your continued use of the Site serves as consent for these cookies.
13.1. A cookie is a small text file that gets sent by the servers of the Site to your hard drive and can only be read and interpreted by the Site’s servers, for the purpose of identifying the user and allows access to portions of the website, thus alleviating the need to continually log in with your username and password. No Personal Information is stored in the cookie, and there is nothing on it that can identify you personally. Cookies may be stored within your system. To the extent I use cookies, I can only access information from a cookie sent by one of the Sites, not other websites. I may use cookies to personalize your visit to my Sites because tracking usage allows me to best determine the needs of my customers and advertisers.
13.2. Cookies have an important function in how you interact while visiting the Site, ensuring the usability of the Site’s different features, helping the Site understand your preferences, and thus can improve your experience on the Site. If you do not want cookies from the Site, simply adjust the settings in your web browser to disable cookies. This may change the way you access the Site and may also render some of the Site’s features unusable, but of course, it is your choice to do so.
14. Disclosure of Personal Information. Healing Daruma will NEVER sell or license any Personal Information we collect from you. Healing Daruma is not liable for any disclosure of your Personal Information by any third party, particularly the ones outlined in section 5.4 above. By purchasing the services and products offered by Healing Daruma, you agree to be bound to and consent to the provisions of our third parties’ privacy policies. In the event that Healing Daruma changes its practices, you will be notified, and you will be able to opt out of Healing Daruma using your Personal Information by contacting us at legal@healingdaruma.com.
14.1. You have the right to request access to the information we have for you. You can do this by contacting us at your legal@healingdaruma.com. We will respond within 45 calendar days from the day the request is received. If there are extenuating circumstances preventing the fulfillment of your request, we reserve the right to reasonably extend our response due date, if reasonably necessary, and will notify you of such extension electronically. We will make sure to provide you with a copy of the data we process about you. In order to comply with your request, we may ask you to verify your identity. We will fulfill your request by sending your copy electronically unless the request specifies a different method. If you believe that the information we have about it is incorrect, or if you wish to remove your private information (such as an email address provided in an opt-in), you may contact us at your legal@healingdaruma.com. Any data that is no longer needed for the purposes specified herein will be deleted.
14.2. I do not give away, sell, rent or lease any users’ personally identifiable information to any merchant, advertiser or web publisher. However, non-personally identifiable user information (such as usage pattern, browser type, and your computer) may be shared with third party businesses or advertisers with which I have a business or contractual relationship. I reserve the right to disclose personal information when needed to comply with the law or a legal process, cooperate with investigations of purported unlawful activities, to identify persons violating the law, in connection with the sale of part or all of Healing Daruma’s or its affiliates' assets, or to enforce my Terms of Use.
14.3. Please keep in mind that if you disclose personally identifiable information in a public manner through the Sites, this information may be collected and used by others accessing those portions of the Sites. I do not monitor information you disclose on the Sites nor do I accept any liability associated with your voluntary disclosure of the same.
14.4. You are responsible for reviewing the privacy statements and policies of other websites you choose to link to or from the Sites, so that you may understand how those sites collect, use and store your information. I am not responsible for the privacy statements, policies or content of any other websites. Websites containing co-branding (referencing my name and a third party’s name) contain content delivered by the third party and not me.
15. Use of Information with AI. I will take all possible technical, administrative, and organizational precautions necessary to keep your data safe including but not limited to taking all actions within my control to keep this GPT private, barring OpenAI from scraping information from this custom GPT, and only requesting necessary information from you. However, no Internet or email transmission is ever fully secure or error free, and we cannot guarantee that OpenAI does not utilize information for its own purposes. Thus, we strongly encourage you to take special care in what information you send to us through this app or the use of any GPT on our site. Additionally, we strongly recommend you do not input any information into the GPT provided that would be deemed private or unnecessary including identifying information of yourself or another person. You should take special care in deciding what information to input into this GPT, and only input information into the GPT that is minimally necessary for your desired output. We will continue to research and review current security law, and review our security measures and privacy policies specifically in relation to AI and custom GPTs. By using this site, and any GPT capability provided therein, you expressly agree and acknowledge that you are doing so by your own volition and assume all risks associated with such action.
16. Limitations. By using the Sites you agree that I am not responsible for: (i) any disclosure of your personal information made by you to a third party through your use of the Sites; (ii) any disclosure of your personal information obtained illegally from me; or (iii) any accidental disclosure of your personal information made by me.
17. Choice of Laws and Venue. This Privacy Policy and the use of the Site are governed by the laws of the United States and the State of Tennessee. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of Tennessee. If a dispute arises, we agree to first resolve it through binding arbitration to take place in the State of Tennessee.
18. Your Consent. By choosing to provide Healing Daruma with your Personal Information, you are consenting to its collection, use and disclosure in accordance with the principles outlined in this Privacy Policy. If you are under the age of 18, you must not provide any Personal Information to us without the consent of your parent or guardian or as otherwise provided for by applicable law.
19. Protecting Your Privacy. Healing Daruma is committed to protecting your privacy. Security measures, such as using passwords on servers and computers and locked cabinets where Personal Information is stored, have been adopted to protect your Personal Information against loss or theft, unauthorized access, disclosure, copying, use or modification. Online transactions are completed using third-party applications outlined in section 5.4 above. Please refer to the third parties’ privacy policies, of which links have been provided above, for clarification on how your transaction and Personal Information will be handled. Healing Daruma makes no promises, warranties or representations about the manner in which your Personal Information is handled by third parties and bears no liability whatsoever for their use of them.
20. Verifying your Identity. Healing Daruma will ask you to verify your identity when you contact us or submit a request regarding your Personal Information. Healing Daruma will ask you to provide sufficient information that allows us to reasonably verify that you are the person who we collected Personal Information about.
21. The Internet Can Be Unreliable. The internet is, by its nature, inherently open and subject to the interception of information. We cannot guarantee that the information you provide to Healing Daruma over the internet or otherwise will not be intercepted by third parties while it is being communicated by means that are outside of Healing Daruma’s control.
22. Verifying and Amending Your Personal Information. Healing Daruma tries to ensure that all Personal Information about you that is in our possession is accurate, complete and up-to-date. Please contact us at legal@healingdaruma.com to advise us of any changes to your Personal Information. You may request access to the Personal Information held by Healing Daruma at any time or seek to make corrections to it.
23. Arbitration. Any controversy or claim arising out of or relating to this Agreement or the breach of this agreement shall be settled exclusively by arbitration. You also agree that should arbitration take place, it will be exclusive to the courts of the State of Tennessee or such other arbitrator mutually agreed upon by the parties. The arbitrator’s decision shall be final and binding on both parties and enforceable in any court of competent jurisdiction. The costs of the arbitration shall be borne by the losing party. The arbitration award shall be final and binding upon the parties, and the parties hereby waive any rights to appeal or challenge the award to the extent permitted by applicable law. This arbitration clause shall survive the termination or expiration of this contract.
